Terms of Service

By using Geosift, you agree to these terms. Key points: you own your data, we provide the service as-is, and you're responsible for using it lawfully.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Geosift ("Service"), operated by Geosift ("we," "us," or "our"). By accessing or using Geosift, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use after changes constitutes acceptance. We'll note material changes at the top of this page.
2. Account Terms
Registration
To access certain features, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Account Eligibility
- You must be at least 13 years old to use Geosift.
- If you use Geosift on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- One person or entity may not maintain multiple free accounts to circumvent plan limits.
Account Security
You are responsible for keeping your account secure. Notify us immediately at support@geosift.io if you suspect unauthorized access to your account.
3. Acceptable Use
You agree to use Geosift only for lawful purposes. You may not:
- Upload or process data that you do not have the legal right to use or share
- Upload data containing personally identifiable information without appropriate consent from those individuals
- Use Geosift to transmit malware, spam, or other harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use Geosift in ways that violate applicable laws, regulations, or third-party rights
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Resell or sublicense access to Geosift without prior written agreement
- Use automated systems to scrape, crawl, or overload the Service
We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscription & Billing
Plans
Geosift offers Free, Pro ($49/month), and Team ($149/month) plans. Feature details for each plan are described on the Pricing page.
Billing
- Paid plans are billed monthly in advance.
- Payments are processed by Stripe via our payment platform. By subscribing, you authorize charges to your payment method on each billing date.
- All fees are in USD and exclusive of any applicable taxes (VAT, GST, etc.), which are your responsibility.
Upgrades & Downgrades
You can upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the end of the current billing period.
Cancellation
You may cancel your subscription at any time. Your access to paid features continues until the end of the current billing period. We do not offer prorated refunds for partial months.
Refunds
Refunds may be issued at our discretion for billing errors or exceptional circumstances. Contact support@geosift.io within 7 days of a charge if you believe an error occurred.
Free Plan Limits
Free plan usage is subject to the limits described on the Pricing page. We reserve the right to adjust free plan limits with reasonable notice.
5. Data Ownership
You own your data. Geosift claims no ownership over the data you upload or create using the Service.
Your Data
All CSV files, GeoJSON, shapefiles, and other data you upload remain your property. We do not claim any intellectual property rights over your uploaded content.
License to Provide the Service
By uploading data, you grant Geosift a limited, non-exclusive license to store, process, and display that data solely for the purpose of providing the Service to you. This license ends when you delete your data or close your account.
Data Export
You can export your data at any time in standard formats (GeoJSON, CSV) from within the app. We encourage you to maintain copies of important data.
Shared Maps
When you create a shared map link, you are responsible for the content you choose to share and the audience you share it with. You can revoke shared links at any time.
6. Intellectual Property
Geosift and its original content, features, and functionality are owned by Geosift and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute the Geosift platform itself.
The Geosift name and logo are trademarks. You may not use them without written permission.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as-is" without warranties of any kind. We may:
- Perform scheduled or emergency maintenance that may temporarily affect availability
- Modify, suspend, or discontinue features with reasonable notice
- Impose usage limits to maintain service quality for all users
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOSIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow limitation of liability for certain types of damages, so the above may not apply to you in full.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
Map data accuracy depends on the accuracy of data you upload and on third-party data sources (OpenStreetMap, CartoDB). Geosift does not warrant the accuracy of geocoding results or map tiles.
10. Indemnification
You agree to indemnify and hold Geosift harmless from any claims, losses, or damages (including legal fees) arising from: (a) your use of the Service in violation of these Terms, (b) data you upload that infringes third-party rights, or (c) your violation of any applicable law.
11. Termination
By You
You may close your account at any time by contacting support@geosift.io. Your data will be deleted within 30 days.
By Us
We may suspend or terminate your account if you violate these Terms, your subscription payment fails, or we determine (in our reasonable judgment) that continued access poses a risk to our service or other users. We will provide notice where reasonably possible.
Effect of Termination
Upon termination, your right to access the Service ceases. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, disclaimers, indemnification, and limitations of liability.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
13. Miscellaneous
- Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Geosift.
- Severability — If any provision is found unenforceable, the remaining provisions continue in full force.
- No Waiver — Failure to enforce any provision is not a waiver of the right to enforce it later.
- Assignment — You may not assign your rights under these Terms. We may assign ours in connection with a merger or acquisition.
